Pramod Kumar Singh vs. Bank of Baroda & Ors - Fees of IRP

NCLAT (2020.10.20) in  Pramod Kumar Singh  vs. Bank of Baroda & Ors.[Company Appeal (AT) (Insolvency) No. 911 of 2020] rejected the plea of ex-IRP, that he has been discriminated by CoC / AA for rejecting his claim of expenses.

Excerpts of the order;

20.10.2020 After hearing the Appellant, we find that the Adjudicating Authority has directed the ‘Committee of Creditors’ to pay an additional sum of Rs. 25,000/- to Appellant who was the ex-IRP. Such direction came to be passed in the wake of the additional claim on account of expenses to the tune of Rs.51,000/- and odd not being allowed by the ‘Committee of Creditors’. The Adjudicating Authority further noted that an amount of Rs. 2.50 Lakhs had already been paid to the Appellant towards his fee. Keeping in view of these facts it does not lie in the mouth of the Appellant to say that he has been discriminated.


The appeal is without substance and lacks merit. We accordingly dismiss it.
